Terms of Service

These terms are the agreement between you and Elevar. By creating an account or using the platform, you agree to them. Please read them carefully.
1. Who we are
Elevar ("Elevar", "we", "us") is an online learning platform that pairs courses with Elev, an AI teacher. These Terms govern your access to and use of our website, apps, and services (together, the "Service").
2. Eligibility & your account
You must be at least 13 years old to use Elevar. If you are under the age of majority where you live, you may only use the Service with the involvement of a parent or legal guardian who agrees to these Terms on your behalf.
You're responsible for the activity on your account and for keeping your password secure. Tell us right away if you believe your account has been accessed without your permission. One person or entity may not maintain more than one free account.
3. Using the platform
- Don't misuse the Service, interfere with its normal operation, or try to access it using a method other than the interface and instructions we provide.
- Don't upload content you don't have the rights to, or anything unlawful, infringing, hateful, harassing, deceptive, or harmful.
- Don't attempt to reverse-engineer, scrape, or resell the Service, or use it to build a competing product.
- Courses you enroll in are licensed to you for your own personal, non-commercial learning. You may not copy, share, or redistribute course materials.
4. Creators & content licensing
If you publish a course, you keep ownership of your content. You grant Elevar a worldwide, non-exclusive license to host, store, display, promote, and deliver your content to learners as part of operating and marketing the Service. You are solely responsible for your content, including that you have the rights to everything in it and that it is accurate.
Elevar charges a flat 10% commission on paid sales; you keep the remainder, less any payment-processing fees. Payouts, taxes, and reporting obligations that apply to your earnings are your responsibility.
5. AI features (Elev)
Elev and other AI features generate explanations, quizzes, summaries, and study materials automatically. AI output can be incomplete or wrong — treat it as a study aid, not professional, legal, medical, or financial advice, and verify anything important. To provide these features, the content you submit to Elev may be processed by third-party AI providers (see our Privacy Policy).
6. Payments, subscriptions & refunds
Prices are shown before you buy. Paid subscriptions renew automatically for the same period until you cancel, which you can do any time in Settings; cancellation takes effect at the end of the current billing period. One-time course purchases and subscriptions are subject to our Refund Policy. Payment processing is handled by a third-party processor; we don't store your full card details.
7. Acceptable use & moderation
Your use of forums, reviews, messages, and other community features is subject to our Acceptable Use Policy. We may remove content, or limit or suspend accounts, that violate these Terms or that policy — including, where warranted, without prior notice.
8. Intellectual property
Except for content you or other users provide, the Service and everything in it — the software, design, logos, and the Elevar name — belong to Elevar or our licensors and are protected by law. We grant you a limited, revocable, non-transferable license to use the Service for its intended purpose.
9. Copyright & DMCA
We respect intellectual property rights and expect our users to do the same. If you believe content on Elevar infringes your copyright, send a notice with the details required by the DMCA to elevar.support1@gmail.com. We will respond to valid notices and may remove infringing content and terminate repeat infringers.
10. Termination
You can stop using Elevar and delete your account at any time in Settings. We may suspend or terminate your access if you break these Terms, if we're required to by law, or if continuing to provide the Service becomes impractical. Sections that by their nature should survive termination (such as content licenses you've granted, disclaimers, and limitations of liability) will survive.
11. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee that the Service will be uninterrupted, error-free, or that any particular learning outcome will result from using it.
12. Limitation of liability
To the fullest extent permitted by law, Elevar will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim, or USD $100.
13. Indemnity
You agree to defend and indemnify Elevar against claims, damages, and costs arising from your content, your use of the Service, or your breach of these Terms, to the extent permitted by law.
14. Governing law & disputes
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Texas will have jurisdiction over any dispute that isn't resolved informally. We'd always rather sort things out directly first — email us before filing anything.
15. Changes
We may update these Terms as the product evolves. If we make material changes, we'll let you know by a notice on the Service or by email. Continued use after changes take effect means you accept the updated Terms.
